Regulation, Parliament and Judiciary

Regulators, Parliament and the courts all need room to operate without a subject access request compromising an investigation, breaching parliamentary privilege, or undermining judicial independence. Six exemptions in Schedule 2 protect a wide range of institutions, from the Bank of England to the Charity Commission, but they share only two underlying structures.

This guide sets out which of the six require a prejudice test and which are largely absolute, along with the specific, named list of regulators the regulatory functions exemptions actually cover. Download it if your organisation is itself a regulator, or regularly handles requests that touch a regulator, Parliament or the courts.
